Rosie’s Law: New Illinois Law Will Allow Courts to Decide Pet Custody Battles

Illinois has passed Rosie’s Law, allowing courts to consider a pet’s well-being when resolving custody disputes between separating couples, regardless of their marital status. The legislation marks a shift toward recognizing companion animals' welfare in legal proceedings.

Scheduled to take effect on January 1, 2027, the law allows judges to issue caregiving arrangements, including limited visitation when appropriate. For pets aged 10 and older, courts may also consider factors such as continuity of environment, emotional stability, minimizing stress, and maintaining established routines when making custody decisions.

The law is named after Rosie, a dog whose longtime primary caregiver lost contact with her following the end of a long-term relationship. Supporters say Rosie’s story highlighted a gap in Illinois law and inspired the effort to better protect the well-being of companion animals during custody disputes.
